Expressive Animator EULA

This is the EULA for Expressive Animator

This End-User License Agreement ("EULA") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (the "Customer", “you”) and Expressive Suite SRL ("Expressive") regarding the access and use of Expressive Animator (the "Software").

By continuing to use the Software, you accept to be bound by the terms of this EULA. If you do not agree with this EULA, do not use the Software.

1. License grant

This Software is licensed, not sold to you. Subject to this EULA, Expressive grants you a worldwide, non-exclusive, non-transferable, revocable license to use the Software.

The Software can be used only after obtaining and providing a valid license key, either by purchasing one or as part of a trial. Each valid license key gives the Customer the right to use the Software on a maximum of two devices belonging to that Customer.

2. Restrictions

You may not: decompile, disassemble or reverse engineer the Software or attempt to gain access to its source code; try to modify, distort or block the normal functioning of the Software; distribute, sell, lease or sublicense the Software without our explicit written permission; publish license keys on the Internet or social media.

3. Termination

Failing to comply with this EULA will immediately terminate this license. In addition, you may, at any time, terminate this license for no reason. However, terminating this license will revoke any rights granted by it, and you must immediately stop using the Software.

4. Intellectual property

This Software is the intellectual property of and is owned by Expressive. The structure, organization, and code of the Software are the valuable trade secrets and confidential information of Expressive. Accordingly, the Software is protected by law, including but not limited to copyright laws of the European Union and other countries, and by international treaty provisions. This EULA does not grant you any intellectual property rights in the Software, and all the rights not expressly granted are reserved by Expressive.

5. Privacy Policy

a. Collected data

Expressive does not collect sensitive and personal information about you while using the Software. The information collected is strictly technical and can not identify you as an individual. For data collection, we use Plausible, and the collected data is never shared or sold to 3rd parties. Instead, data collection aims to improve our Software and measure how Customers use it.

b. Registered devices

Customers that have purchased a valid license key may use it to activate the Software. To do that, they must register their device with Expressive and activate the license key for that specific device. During device registration, information about the Customer's device is transmitted to Expressive. We use this information to protect ourselves and our business against abuse and ensure that only legit paying Customers can access and use the Software.

c. Automatic updates

We provide regular updates for the Software. The updates may contain bug fixes, new features, or modifications to the UI or how the Software works. All updates are delivered automatically without prior user consent.

7. Warranty disclaimer

YOU ACKNOWLEDGE THAT THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AT THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THERE IS NO WARRANTY BY EXPRESSIVE THAT THE FUNCTIONS OF THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS AND FOR THE INSTALLATION, USE, AND RESULTS OBTAINED FROM IT.

8. Limitation of Liability

IN NO EVENT AND UNDER NO LEGAL THEORY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, UNLESS REQUIRED BY APPLICABLE LAW (SUCH AS DELIBERATE AND GROSSLY NEGLIGENT ACTS) OR AGREED TO IN WRITING, SHALL EXPRESSIVE BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING AS A RESULT OF THIS EULA OR OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES), EVEN IF EXPRESSIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
